The High Court Koforidua on Tuesday May 8, 2023 dismissed the application for injunction filed by the former Eastern Regional Chairman John Owusu Amankrah popularly known as Jowak.
Jowak sued the NDC party and the entire Executives of the Eastern Region NDC after the regional congress.
In addition to the law suit he filed an application for injunction asking the court to order the duly elected Regional Executives from holding themselves out as the Executives of the party in the region and also for an order directed at the NDC National from recognizing the Executives.
This application essentially was going to incapacitate or stop the Executives and the NDC party from undertaking any activity in the region until the court had decided the case.
This law suit and application was filed by Jowak after the Regional Conferences held at the Koforidua Technical University and his case was that he is the only one who has the power under the NDC constitution to organize the conference so the NDC party led by FEC or the General Secretary of the party don’t have the power to organize the conference except him.
Lawyer Isaac Minta Larbi who is the Chairman of the NDC Legal Team Eastern Region filed the necessary processes in court to defend the action.
In the Affidavit in Opposition filed at the High Court, he argued that the motion for injunction was frivolous and intended to achieve only one thing which is mischief.
Whilst arguing against the motion Lawyer Isaac Minta Larbi submitted to the court that Jowak who is the applicant only acts as the organizer of the Regional conference on a delegated power and at anytime, the party hierarchy could step in to organize the conference when the regional chairman is unable or disabled from doing so.
The application for injunction was heard by the court earlier on and the case adjourned to today for the court to give it’s decision on the injunction application.
The court in it’s ruling delivered today at the High Court Koforidua dismissed the injunction application and stated that the application was only seeking to do mischief as argued by Lawyer Isaac Minta Larbi for the defense.
By dismissing the application the duly elected Regional Executives of the NDC party are free to continue to do their work as the Elected Executives of the party without any interference or restraints from the court.
This ruling is very decisive to the extent that an injunction order against the Executives would have wreaked havoc on the party since the whole party would have been disabled from undertaking any activity in the region.
We are very happy and grateful to Lawyer Isaac Minta Larbi who defended the action and brought an end to this matter which brought a lot of stress and uneasiness to all officers of the party from the region to national.
Whilst jubilating at the court today the party members and faithfuls started calling him the ” Eastern Tsikata”. This is because he recently won another case at the Supreme Court for the NDC at a time nobody expected victory.
Lawyer Isaac Minta Larbi is also a Contestant in the upcoming Parliamentary Primaries in Okere and he is expected to win massively to lead Okere NDC to take the MP seat in Okere in 2024.
