An injunction application filed by the Queen Mother of Sunyani traditional area Nana Akosoa Dua Asor Sika Brayie II against Mr. Yaw Agyare as 1st respondent and Nana Nana Kwaku Sarbeng II, the Akwamuhene and acting president of Sunyani traditional area, will be determined on Friday, 21st February.
Odeefour Ogyeamansan Boahen Korkor II, also known by his private name, Mr. Yaw Agyare was installed as the Sunyani Paramount Chief on January 6, 2024, following the demise of Nana Bosoma Asor Nkrawiri II.
His coronation process has since been challenged by the Paramount Queen Mother of the Sunyani Traditional Area, who is seeking an injunction against the Chief.
The injunction, moved at the house of the Judicial Committee sitting today by Kwame Twumasi-Awuah Esq of Twumasi & Associates, counsel for the petitioner in his affidavit among others, sought to restrain 1st Respondent from styling and conducting himself as paramount chief of Sunyani Traditional Area and furthermore to have anything to do in connection with Sunyani paramount stool.
Additionally, an order to restrain 2nd respondent from introducing or parading Mr. Yaw Agyare as Paramount chief of Sunyani in any manner or whatsoever. And for any such further order(s) as the Judicial Committee will deem fit.
At the judicial committee sitting today, Lawyer Kwame Twumasi-Awuah prayed that Nana Kwaku Sarbeng, by custom, lacked the capacity to nominate a candidate to occupy the vacant paramount stool of Sunyani Traditional Area.
He told the committee that the purported nomination and installation of Mr. Yaw Agyare under a tree in front of the old palace was contrary to custom and law, and the same must be set aside.
Additionally, the queen mother was not involved during the day of the installation of Mr. Yaw Agyare, hence, his installation was inappropriate.
Layer Kwame Twumasi-Awuah said Mr. Yaw Agyare was not validly nominated by the queen-mother of Sunyani Paramount Stool. Therefore, he has not acquired or attained chiefly status and can not style himself as Omanhene of Sunyani Traditional Area.
In contention, counsel for the 1st and 2nd respondents, Lawyer Kwaku Antwi Agyei, moved that the judicial committee should disregard the affidavit tendered by the applicant.
According to the lawyer for the respondents, the queen mother nominated and submitted the names of 7 eligible royals from the Boahen Kokor family to the King makers for selection.
He stated that Mr. Yaw Agyare was unanimously approved by the king makers to ascend the throne.
Lawyer Kwaku Antwi Agyei argued that the contention that Mr. Yaw Agyare was installed under a tree, contrary to custom and law, which was misleading.
According to him, the tree in question is situated within the walls of the old Omanhene palace, making the installation process valid.
He prayed to the judicial committee that the development of Sunyani would retrogress because the stool has remained vacant following the demise of Nana Bosoma Asor Nkrawiri, and therefore, the injunction application should be rejected.
He insisted that the Sunyani Traditional Area tool has remained vacant mid depriving of development and a legitimate Paramount Chief. Hence, the injunction, if granted, will add more woes.
The chairman of the committee, Okokyeredom Sekyi Arko II, speaking on behalf of other committee members, including Suma manhene and Nsawkaw manhene, adjourned the ruling to Friday, February 21.
Lawyer Kwaku Antwi Agyei, who represented the respondents briefing Ark FM on the matter, expressed optimism that his clients’ plea would be granted.
He told Kaakyire Kwasi Afari of FM that he is optimistic about winning the injunction case against his clients.
Lawyer Kwame Twumasi-Awuah, counsel for the petitioner, on the other hand, declined interviews with Kaakyire Kwasi Afari of Ark FM stating his assurance to speak on the matter after the ruling on Friday.
