A 30-year-old driver, Ayisi Maxwell has been sentenced to three months imprisonment for using an unregistered motorcycle, contrary to section 41 of the road traffic Act 683/2004 as amended by Act 761/2008.
Ayisi Maxwell, the accused pleaded not guilty for careless and inconsiderate riding, negligently causing harm one Evelyn Denyo and Mawulawoe Soexwde Tetteh, now deceased in the Asamankese Circuit Court.
He is expected in court again for the other charges he pleaded not guilty for, according to the court presided over by His Honour Abass Abubakari Adams.
Prosecution statement read by Detective chief Inspector Susan Ayaric said the accused resides at Boadua with his family and on 31/12/2020 at about 8:00pm, the accused was in charge of an unregistered Apsonic motorcycle from Asamankese to Boadua.
On reaching a section of the road in front of Madingo House in Boadua, the accused knocked down Mawulawoe Soexwde Tetteh, age 66 who was crossing the road, and Evelyn Denyo who was in her shop on the roadside.
Both the victims and accused were rushed to St. Dominic Hospital in Akwatia for treatment but Mawulawoe Soexwde Tetteh died on arrival.
The rider and Evelyn Denyo were also treated and discharged on 05/01/2021 but the motorcycle rider was later arrested and granted police inquiry bail.
On 08/01/2021, the accused was sent to Kade district court and was charged and granted bail.
After investigation case duplicate docket was prepared and forwarded to the office of the Attorney General in Koforidua for study and advice.
On 15/06/2021, Attorney General’s report recommended that the accused should be sent to Circuit Court for prosecution.
