The Koforidua High Court 2 presided over by His Lordship Justice George Krofa Addae on the 28th June, 2024 delivered a ruling on a case between the Plaintiff (Yaw Adogo) and the Defendants (Joshua Kofi Sogah and Francis Akaglo) which the ruling annulled the tenure of office of the Plaintiff (Yaw Adogo) as unconstitutional hence ordered for the appointment of Interim Management Committee (IMC) Members.
This ruling by the court imply that the current Executives chaired by Yaw Adogo of Peace Branch of Koforidua PROTOA is to be ousted hence an Interim Management Committee members must be appointed with immediate effect.
The decision of the court in pursuant to Article 13 (C) of the Association’s Constitution led to the appointment of an Interim Management Committee (IMC) members through a secret ballot and elected the following Interim Management Committee Members of Koforidua Peace PROTOA.
Joshua Kofi Sogah as Chairman, Samuel Appiah as Vice Chairman, Emmanuel O. Ankamah as Secretary, Hajaratu Issah as Treasurer and Amidu Abubakar as Chief Driver constituting the Interim Management Committee IMC of Koforidua Peace PROTOA in the next six months period pending an election in December 2024.
Meanwhile , the earlier date set for the handling over ceremony was marred by a near violent clash between a group of individuals allegedly from the camp of the expelled chairman of Koforidua Peace PROTOA Yaw Adogo and the newly constituted Interim Management Committee Members.
However, upon reading the affidavit of Joshua Kofi Sogah on 26th July, 2024 in support of Motion on Notice for an Order directed at the Regional Police Commander of the Ghana Police Service , Eastern Region for Police Protection , the Koforidua High Court (Commercial Division) has ordered that the handling over ceremony should be held under Police Protection.
The order for Police Protection by the court reads “upon reading the affidavit of Joshua Kofi Sogah sworn to and filed on the 26th July , 2024 in support of Motion on Notice for an Order directed at the Regional Police Commander of the Ghana Police Service Eastern Region herein for Police Protection”
“And upon hearing Leonard Sedzro Esquire Lawyer for and on behalf of the Defendant/Applicant and Suelman Musah Esquire Lawyer for and on behalf of the Plaintiff/Respondent herein”
” It is hereby ordered that ; the Regional Police Commander of the Ghana Police Service Eastern Region is by himself or his Officers and Men directed to grant protection to the Applicants for any official duties they are required to perform at the Office of the Peace Branch of the Progressive Transport Owners’ Association, PROTOA, Koforidua” the court ordered.
