Kwabena Agyei Agyapong, the former general secretary of the New Patriotic Party (NPP), has contested the Office of the Special Prosecutor’s (OSP) decision to designate former Finance Minister Ken Ofori-Atta as a fugitive.
In an interview with Citi FM on Tuesday, June 3, 2025, Mr. Agyapong contended that such a pronouncement is solely within the jurisdiction of the courts and not the investigative authorities.
“You are not a judge yourself to be able to declare someone a fugitive just because you cannot have access to the person, ” he said.
His remarks follow Special Prosecutor Kissi Agyebeng’s public declaration that Mr. Ofori-Atta is a fugitive because he has not returned to the nation and has not cooperated with current investigations.
Mr. Agyapong urged state institutions to function within the bounds of the law and emphasized the significance of due process in seeking responsibility.
“What happens to the basic law which says that you are innocent until you are proven guilty?”
According to the Office of the Special Prosecutor’s defense, Mr. Ofori-Atta has not cooperated with attempts to strengthen the case against him and has not provided enough proof to back up allegations that he is medically ill.
