Private legal practitioner, Lawyer Isaac Mintah Larbi, has explained that Kin Offori Atta has the opportunity to file an appeal, citing key legal grounds related to immigration and extradition.
According to him, the issues being discussed fall into two main areas. The first is immigration, while the second is extradition, which he described as a government-to-government process. He explained that extradition occurs when a country officially requests another country to surrender a person who is wanted for legal reasons, likening it to a situation where someone commits an offence in another person’s hometown and is formally requested to be brought back.
Lawyer Mintah Larbi further clarified that immigration issues, on the other hand, are different from extradition. He noted that immigration matters often arise when a person personally regrets relocating or is found to be unlawfully residing in another country. In such cases, immigration authorities may determine that the individual is a foreigner or does not meet residency requirements and therefore ask the person to return to their country of origin.
He added that even if the immigration aspect of a case is settled, an unresolved extradition matter could still provide valid grounds for an appeal. This, he emphasized, makes the appeal process an important legal option available to Kin Offori Atta.
