Brogya Genfi, a former National Youth Organizer Aspirant of the National Democratic Congress (NDC), has filed a crucial application at the Supreme Court.
The application aims to serve Hon. Habib Iddrisu, a Member of Parliament for the New Patriotic Party (NPP) representing the Tolon Constituency, through Substituted Service.
Brogya Genfi’s decision to resort to Substituted Service follows multiple unsuccessful attempts to serve Hon. Habib Iddrisu with an application that invokes the Original Jurisdiction of the court.
The application seeks to interpret specific constitutional articles, namely Article 94(2)(c)(i) and Article 94(5)(2) of the 1992 constitution.
Lawyer Isaac Minta Larbi, a legal representative for Brogya Genfi, filed the Exparte application.
This legal maneuver requests the court’s permission to serve Hon. Habib Iddrisu through Substituted Service, involving the posting of relevant documents on the notice boards of institutions such as the Supreme Court, Parliament of Ghana, and the High Court in Accra.
Brogya Genfi asserts in the Substituted Service application that all previous efforts to serve Hon. Habib Iddrisu have proven futile.
The court has scheduled the hearing for this application on December 14, 2023.
This recent legal action follows Brogya Genfi’s earlier writ at the Supreme Court, challenging the eligibility of Hon. Habib Iddrisu as an MP.
The core argument revolves around allegations that Hon. Habib Iddrisu, convicted in Australia for fraud, did not satisfy the constitutional requirement of a 10-year gap from the conviction when submitting his nomination for the parliamentary elections in 2020.
