A crucial ruling is expected on July 31, 2025, as the High Court decides whether to proceed with a legal challenge brought by suspended Chief Justice Gertrude Torkornoo against the Attorney General.
Justice Torkornoo is seeking to halt impeachment proceedings initiated under Article 146 of Ghana’s 1992 Constitution. She has filed a certiorari application, claiming that the process undermines her constitutional rights and lacks due legal basis.
At the heart of the case is a motion filed by the Attorney General to strike out the Chief Justice’s judicial review application. The court’s decision on that motion will determine whether Torkornoo’s challenge is allowed to proceed.
This legal standoff follows the dismissal of three earlier injunctions by the Supreme Court, each aimed at pausing the impeachment process until the proper constitutional interpretation could be obtained. So far, those efforts have failed to stop the proceedings.
During a tense hearing on Wednesday, both sides sparred over procedural matters, including whether the Attorney General must provide additional details in response to correspondence from Torkornoo’s legal team—submitted as Exhibit CJ1.
The outcome of this case could set a precedent for how constitutional office holders are removed and how far judicial review can extend in impeachment matters.
