A Banker at Data Bank has dragged a mechanic in Koforidua before the District Magistrate Court “A” over an alleged failure to repair a vehicle after receiving more than GHC16,700 to buy second hand engine and gear box.
The complainant, Benjamin Ohene Ofori, a banker with Data Banker and farmer at Apenkwa-Koforidua, told the court that he entrusted his Hyundai Accent 2013 model (GX 7881-14) to the accused, Ayinka, in January 2024 after the car developed gearbox and engine faults.
According to Mr. Ofori, the mechanic initially diagnosed the problem as faulty engine sensors and demanded GHC1,700 for replacement.
Despite payment, he said the mechanic failed to provide receipts or fix the car.
The plaintiff explained that after months of excuses, he reported the case to the Effiduase Police Station where investigations were assigned to a CID officer.
Subsequently, the defendant allegedly told him the problem was bigger than earlier stated and required a new engine, gearbox and control board at the cost of GHC15,000.
Mr. Ofori said he secured a loan from a microfinance institution and paid the amount in May 2024 in the presence of a police officer.
However, the defendant has still not repaired the car or refunded the money.
The banker further lamented that his vehicle has since been left at the mechanic’s workshop in a deplorable state, exposed to harsh weather conditions.
He is therefore praying the court to compel the defendant to either fix the car or refund the GHC16,700 received.
However, the Mechanic explains that,after diagnosing the car he noticed it was converted from Automatic to manual.
He said the engine had a major fault which he tried to repair by changing the rings but could not work well.
According to him, he advised the client to buy a new engine and gear box to revert the car to automatic transmission.
Since the client lamented he has no money , the mechanic used his personal money to pay for the cost of transportation of the engine, brought auto electricians from Accra to lay new wiring system to revert the car to automatic ,and other cost he incurred.
The mechanic said the car is working but left with few things to fix which the plaintiff has failed to corporate to get it replaced hence packed under a she’d contrary to claims that it has been left under harsh weather condition.
