Lawyer Isaac Minta-Larbi, the Eastern Regional Director of Legal Affairs of the National Democratic Congress (NDC), has explained that the judicial system in Ghana operates according to clearly established legal procedures that must be followed by all parties involved in a court case.
Speaking in an interview on Bryt Adekyee mu Nsem, Lawyer Minta-Larbi said court proceedings are guided by the law, and every stage of a case is conducted in accordance with laid-down legal processes. He stressed that decisions made by the court are based on the law and not on personal opinions or public pressure.
According to him, whenever a case is called before the court, the presiding judge, the accused person, the defence lawyer, and the Attorney-General’s representative or prosecutor must all be present. He explained that if the matter cannot be concluded on the scheduled date, the parties meet before the judge to agree on another date for the hearing to continue.
He noted that the next hearing date is not chosen arbitrarily but is agreed upon by all parties in open court. Once a date is fixed, it is officially entered into the court’s records, ensuring that everyone involved is aware of the next sitting and has adequate time to prepare.
Lawyer Minta-Larbi further explained that the official court record serves as evidence of everything that takes place during proceedings, including the attendance of the parties, the submissions made, and the dates agreed upon for subsequent hearings. This, he said, promotes transparency, fairness, and accountability within the justice delivery system.
He urged the public to have confidence in the judicial process and avoid making assumptions about court decisions without understanding the legal procedures involved. He emphasized that the courts are governed by the rule of law and that every accused person is entitled to a fair hearing as guaranteed by the Constitution.
