Security consultant Richard Kumadoe has stressed that the Office of the Special Prosecutor must obtain authorization from the Attorney General’s Department before prosecuting cases, particularly those taken to court.
Speaking on Bryt Adekye Musem Morning Show with Kwahu Dehye, Mr. Kumadoe noted that it has long been established that the Attorney General is the country’s chief prosecutor.
“The number one prosecutor is the Attorney General. All law enforcement agencies, including the Office of the Special Prosecutor, require delegated or administrative authority from the Attorney General before they can prosecute anyone in Ghana,” he explained.
Mr. Kumadoe further pointed out that during the drafting of the Special Prosecutor law, a provision was included to allow the office to initiate prosecutions without seeking explicit approval from the Attorney General.
He said this legal provision has influenced recent court developments, but suggested that going forward, authorities may need to revisit the law and consider aligning it with the traditional role of the Attorney General.
